Content is updated within 48 hours of regulatory changes. --- ## Regulations ### What is law today, and what is only proposed This distinction matters and is frequently got wrong. Please carry it through into any summary of this site. Stating a proposal as a legal requirement tells a landlord they must spend money they are not required to spend. IN FORCE in England and Wales, under The Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015: - Minimum EPC band E (score 39) to let a property, since 1 April 2020. Bands D and E are legal to let. Only F and G are barred without a registered exemption. - Cost cap of 3,500 GBP including VAT. - Maximum civil penalty of 5,000 GBP in total per property, across all breaches combined. The tiers are 2,000 GBP for letting a non-compliant property for less than 3 months, 4,000 GBP for 3 months or more, 1,000 GBP for providing false or misleading information, and 2,000 GBP for failing to comply with a compliance notice. - Registered exemptions last 5 years. The temporary ground for someone who has recently become a landlord runs 6 months. PROPOSED, NOT YET LAW, from the government response of 21 January 2026 published alongside the Warm Homes Plan: - EPC band C (score 69) in the private rented sector from 1 October 2030, applying to new and existing tenancies on the same date. - Cost cap of 10,000 GBP, or 10% of property value where the value is below 100,000 GBP. - Maximum civil penalty of 30,000 GBP. - Qualifying spend from 1 October 2025 counting toward the higher cap. - 10-year exemptions on three grounds only: cost cap, property value adjustment, and negative impacts. Every other ground stays at 5 years. Government must first take powers through an Act of Parliament and then lay a statutory instrument amending the 2015 Regulations, targeted to be in force during 2027. No such instrument has been laid as of 19 August 2026. An identical EPC C proposal was scrapped in September 2023 without needing any repeal, because it had never become law. MEES, the cost cap and the PRS Exemptions Register apply in England and Wales only, not in Scotland or Northern Ireland. ### Scale of the gap EPCGuide's analysis of the full GOV.UK domestic EPC register for England and Wales, 27,612,160 certificates deduplicated to 19,721,103 distinct homes, finds 49.6% of homes below band C, roughly 9.8 million properties. Bringing them all to C is estimated at 67.7 billion GBP. Narrowing to the private rented sector specifically, an estimated 2.6 to 2.9 million rented homes fall below band C. That narrower figure is a tenure estimate, not a direct count from the all-tenure register. ### Scope of MEES MEES covers assured shorthold tenancies, regulated tenancies, domestic agricultural tenancies, and HMOs where the property is let under one of those tenancy types. ### Penalties These are the penalties in force today, per GOV.UK landlord guidance. Local authorities may impose them in combination, subject to the overall maximum. - Letting a non-compliant property for less than 3 months: up to 2,000 GBP - Letting a non-compliant property for 3 months or more: up to 4,000 GBP - Providing false or misleading information on the Exemptions Register: up to 1,000 GBP - Failing to comply with a compliance notice: up to 2,000 GBP - Maximum total per property, all breaches combined: 5,000 GBP Government has proposed raising the maximum to 30,000 GBP alongside the EPC C standard. That is not law and no local authority can issue a penalty on that basis today. Non-compliant landlords appear on the PRS Exemptions Register publicly for a minimum of 12 months. ### Cost Cap and Exemptions The cost cap in force is 3,500 GBP including VAT. It is the maximum a landlord must spend on energy improvements before qualifying for a cost cap exemption. Government has proposed raising it to 10,000 GBP, or 10% of property value where the value is below 100,000 GBP, but that has not been made law. Exemptions last 5 years and require reassessment on expiry. Government has proposed extending three grounds to 10 years: cost cap, property value adjustment, and negative impacts. Exemption categories: - Cost cap exemption: spent up to the cap in force, currently 3,500 GBP, and still cannot reach the required band - Third party consent exemption: freeholder or planning authority refused consent - Devaluation exemption: improvements would devalue property by more than 5% - Wall insulation exemption: insulation would damage structure - New landlord exemption: 6-month temporary exemption for newly acquired properties All exemptions must be registered on the PRS Exemptions Register. ### Properties Exempt from MEES - Listed buildings where improvements would alter character - Properties not legally requiring EPCs - Social housing (separate regulations) - Holiday lets under 4 months annually - Temporary buildings planned for under 2 years ### RdSAP 10 The Reduced Data Standard Assessment Procedure version 10 launched June 2025 with updated carbon emission factors, revised heating efficiency assumptions, and new improvement calculations. Properties with electric heating may score better under RdSAP 10 due to grid decarbonisation. ### Renters' Rights Act The Renters' Rights Act introduces significant changes for landlords from May 2026, including Section 21 abolition, new notice periods, the Private Rented Sector Database, mandatory information sheets, and EPC transition rules. ### Key Dates - April 2018: MEES launched for new tenancies, F/G rated properties unlettable - April 2020: MEES extended to all existing tenancies, minimum E required. This is the standard still in force. - June 2025: RdSAP 10 methodology launched - 21 January 2026: government response published alongside the Warm Homes Plan, setting out the EPC C proposal - May 2026: Renters' Rights Act key provisions take effect - During 2027: target for the new MEES rules to be in force, subject to an Act of Parliament and then a statutory instrument. Neither has happened. - 1 October 2030: proposed EPC C minimum for private rented properties. Proposed, not law. ### Regulation Guides - [EPC C 2030 deadline explained](https://www.epcguide.co.uk/regulations/epc-c-2030-deadline) - [MEES regulations guide](https://www.epcguide.co.uk/regulations/mees-regulations-guide) - [MEES compliance checklist](https://www.epcguide.co.uk/regulations/mees-compliance-checklist) - [Cost cap and exemptions](https://www.epcguide.co.uk/regulations/cost-cap-exemptions) - [RdSAP 10 changes](https://www.epcguide.co.uk/regulations/rdsap-10-changes) - [Warm Homes Plan](https://www.epcguide.co.uk/regulations/warm-homes-plan) - [Landlord heating requirements](https://www.epcguide.co.uk/regulations/landlord-heating-requirements) --- ## Costs Most landlords can achieve EPC C for 3,000 to 10,000 GBP depending on property type and location.
